Coop, I would encourage and support you to decide what is best for you and protects you from our corruptly litigious society. It is a shame this is even an issue. I have really enjoyed being a part of this boards community the last few months or so, but would never expect you, or anyone, to put themselves in a position of risk for my entertainment. What ever you decide, my thanks for developing and hosting this board. If there is a compromise to continue, great. If not, my well wishes to you and everyone has joined and enjoyed each others virtual company.

I'm working on a way to disable images. If I can do that, then this will become a non-issue. Ok, as of now inserting images is disabled. Using the 'Insert Image' button will result in only the link to the image being posted. This should be all that is needed to avoid the issue. I'll continue to study on this and see if there is a way around it.

Well hope this satisfies them.... I should think so, since every image on this site should now be gone, except ones that were uploaded directly from someone's computer. And that is no longer an option either. At least we can still have videos.

I don't know what the full story is with AeroNewsDaily. Did they shut down because a judge ordered them to, or did they get summoned to court, or were they just threatened with a bullshit cease and desist letter? What happened to AeroNewsDaily? Did someone say "Pay $150,000 or else we'll sue?" If so, that's bullshit and it's also illegal.
I'm assuming Getty Images sent them a cease-and-desist letter, right? Is that what happened?
What sexysteventyler.com does is legally-questionable. They aren't really allowed to take someone else's photos and redistribute them. Building entire photo galleries of someone else's copyrighted photos isn't really protected by fair use laws at all. But most of the photo-posting that happens here is protected. I'd assume that AeroNewsDaily was using those photos under protection of Fair Use laws also.
It makes me angry when big companies use their might to threaten "little people" in illegal and unfair ways. It makes me angry when big companies imagine that "little people" are uninformed about their rights. It makes me angry that Getty Images thinks it can push anyone around with Cease and Desist letters. FAIR USE LAWS, FUCKERS!
I HATE IT WHEN PEOPLE MAKE BULLSHIT EMPTY LEGAL THREATS AGAINST OTHERS!!!!
This makes me very angry. I never visited AeroNewsDaily and I don't know anything about them and I don't know what happened, but it just sounds like something that would make me angry.

Well, I would rather have this forum then going over to a new place again. Even if it means we can't have images. This all reminds me of Fat Tom from AF1 when Fans Rule was in charge. After I posted on another fan club site that Fans Rule ran (Christina Aguilera) warning people over there not to buy tickets or packages through the fan club because if Christina ever canceled a show you would never see your money again. I got a call from Fat Tom himself threatening me with a cease and desist order telling me he spoke to his legal team and I am no longer permitted to post on other forums about what was going on with AF1. I basically laughed in his face when he threatened me with a law suite. After I laughed at him for threatening me with a law suite he threatened me with being banned from AF1. I told him to do what he had to do and hung up.
Funny part is Christina did cancel some shows and the fans didn't get their money back until Christina personally offered refunds and went after Fans Rule herself instead of leaving the burden on her fans to deal with them. This is why I will always have the utmost respect for Christina. She took care of her fans when other bands coughAerosmithcough didn't.
But I digress, I am glad a solution has been found. I would hate to lose this place.

Well, that was a lot to take in, but I do have a few points to touch on. First, I apologize for dragging aeronewsdaily into this. They were kind enough to warn me though, and that's what started this whole mess, but I am very grateful for the warning because I was thinking exactly the same way, that if an image is on google, then it is free to use as you please.
I also want to clarify that I don't know for sure that it was Getty. Sak never mentioned who tried to sue, just that it was over an image. In my research, Getty is just the name that comes up time after time.
Anyway, my many hours of research has taught me how very wrong I was. If an image owner such as Getty finds that you are using their image without paying the proper royalty, they have a right to sue you for the royalty fee plus a portion of the cost it took for them to track illegal users down. I don't like it, but many online lawyers have said this is true.
What they do NOT have the right to do is to threaten to sue you for a huge sum of money IF they do not plan to go through with it. This is what has the internet community up in arms. Many small web owners, such as aeronewsdaily cave in to the pressure of these people and pay a reduced fine to avoid going to court. This is the numbers game they are playing.
Sak assured me that these people are very ruthless and relentless, and online research backs this up. So even if they were 100% full of hot air, its a situation I'd rather not deal with. I do this for fun, not for stress and headaches.
The next problem is that they are NOT 100% full of hot air. As of January this year, Getty has started following up on their actions and actually taking people to court. Some speculate that this is in response to the online community beginning to ignore their threats due to many forum people stating that if you ignore them long enough they will go away.
I could go on, but I'm sure most stopped reading paragraphs ago. Bottom line is that I'd rather just forgo images than run the risk of dealing with the bullshit. Its not a big deal to me. We still have videos and conversation, so be it, its good enough for me.

You don't have to pay a royalty to comment on their photos! FAIR USE LAWS. Imagine if we had to pay royalties every time we wanted to talk about any piece of copyrighted work - what a hindrance to free speech it would be! The law really doesn't have Getty's back on this.
Yes, it's true that you can't just pull an image of Google and use it. You can't use images in advertising, or in a logo, or in the layout of your site. But you can pull an image off google and talk about it. Nobody's copyright trumps your freedom of speech. No, you don't have to pay a royalty fee in order to exercise your freedom of speech.
I doubt they really intend to go through with suing AeroNewsDaily, since I doubt they can actually win in court (although, I don't know what AeroNewsDaily was doing with the photos). So, they've just done two totally illegal things, right there! This is so much bullshit that I don't even know where to start. If I ran AeroNewsDaily, I'd head to the courthouse and file a lawsuit tomorrow morning.
If they really drag (is it sakutak?) into court, I hope Sakutak knows that (she?he?) has the right to sue them back for legal expenses and general bullshit. Anyone can sue anyone else for any reason, which means that Saktutak can sue them right back. If they really want to be ruthless and agressive about "protecting their copyrights," of course they should be aware that we are able to also be ruthless and agressive about protecting our own rights. It drives me crazy that large companies imagine that they can trample the rights of "common folk" and it drives me even crazier that "the common folk' bend over and take this shit.
Maybe AeroNewsDaily really did violate their copyright. How was AeroNewsDaily using Getty's photos?
No, Getty doesn't get to shut down the entire internet because they'd rather ignore fair use laws.

Well, I just read up on this online. Getty is a predatory company who is purposely going after small website owners who lack the resources to fight in court....and pressuring them hard to settle out of court despite the fact that most likely, Getty would be unable to win the case if it actually went to court.
This is absolutely disgusting and despicable.
We should boycott Getty because they are a vile and predatory company who prey on small website owners with no regard for free speech rights and fair use protection. Let's be a Getty-free board ON PRINCIPLE. We shouldn't avoid Getty's images because we're "afraid of getting sued." We should avoid using any of Getty's images because they are VILE AND PREDATORY BULLIES WHO HAVE ATTEMPTED TO EXTORT A MEMBER OF OUR COMMUNITY.
Let's rally behind AeroNewsDaily, a victim of this disgusting and unconscionable scam. The online Aerosmith community BOYCOTTS Getty!
Let's certainly write up a disclaimer stating our rights and calling Getty out for their bullshit.
