Steven Tyler Responds To Lawsuit Alleging Sexual Assault By Woman Who Says She Was 16 At The Time, Singer Claims Consent & Immunity Since He Was Her Legal Guardian
Story by Tom Tapp Steven Tyler is seeking dismissal of a lawsuit filed in December by a woman who alleges the Aerosmith frontman had an illicit relationship with her when she was 16 years old and he was 25, saying her claims are barred in whole or in part by consent on her part. In a seven-page answer to the plaintiff’s allegations filed Tuesday, Tyler’s attorneys state that the plaintiff has not “sustained any injury or loss by reason of any act or omission on the part of (Tyler)” and that the plaintiff is not entitled to any damages from the 75-year-old musician. “Plaintiff’s claims are barred in whole or in part because (Tyler’s) actions were legitimate, good-faith, justified, nondiscriminatory and/or non-retaliatory,” according to Tyler’s attorneys’ court papers, which further allege that the plaintiff’s claim for punitive damages violates his right to due process. Tyler’s filing also contends that the plaintiff’s claims are fully or partially barred by alleged consent on her part and that he had at least qualified immunity as her onetime guardian. In her suit filed Dec. 27, the plaintiff Julia Holcomb alleges that Tyler convinced her mother to grant him guardianship over her when she was 16 years old, allowing her to live with him and engage in a sexual relationship. She alleges they were together for about three years beginning in 1973. The plaintiff became pregnant in 1975, causing Tyler to be simultaneously both the father of the plaintiff’s unborn child and her legal guardian, according to the suit, which further states that the Catholic plaintiff later relented under Tyler’s pressure and had an abortion. The plaintiff subsequently “made a conscious decision to leave and escape the music and drug-addled world seeking to be free from the sexualized culture created by Tyler and the industry,” according to her suit, which additionally states that she went on to have a family and become active in her faith. But the plaintiff maintains her life was “shattered” when Tyler released memoirs characterizing his alleged abuses of her as “a romantic, loving relationship” without her knowledge or consent in order to obtain fame and financial benefit for himself and his managers, agents and publishers. A case management conference in the lawsuit is scheduled July 24. PREVIOUSLY in December: A woman who says she had a sexual relationship with Steven Tyler in 1973 when she was 16 has filed a lawsuit against the Aerosmith frontman, Rolling Stone reports. The suit, filed under the California Child Victims Act, accuses Tyler of sexual assault, sexual battery, and intentional infliction of emotional distress. Under the act, the statute of limitations was temporarily lifted for survivors of childhood abuse. Tyler is not named in the lawsuit, but plaintiff Julia Holcomb has spoken publicly about what she said were her experiences with Tyler, who was then about 25, which she says lasted for three years. Tyler, for his part, writes in his memoir that he “almost took a teen bride” whose parents “fell in love with me, signed a paper over for me to have custody, so I wouldn’t get arrested if I took her out of state. I took her on tour with me.” Holcomb maintains that Tyler plied her with drugs and alcohol, had sex with her and, yes, took her on tour with him. She became pregnant with his child at 17 and the singer convinced her to have an abortion. Interestingly, Holcomb’s lawsuit refers to John Does numbering 1 through 50, so there may be more shoes to drop if the lawsuit progresses. Aerosmith canceled eight shows of its Las Vegas residency in May because Tyler needed to return to rehab. What exactly is Steven claiming immunity from here? Non-consent? Or the settlement/lawsuit itself?

Steven is trying to claim (through his lawyer) that when Julia’s parents signed her over to him to be her guardian, that gave him immunity from having sex with a minor…and since the parents knew he was having sex with her, that would give him consent. The only problem for Steven is there is no such immunity in any laws on the books then or now.
I am still very surprised he hasn’t settled this law suit. It’s not like the law suit is a criminal proceeding.

any heads up on this story? Is this going to court anytime soon? One thing I really hate about the times we live in is that people won't call spade a spade. Chicks got all the courage to whore out and sue 50 years later, but guys have no balls and they drop the ball. it's harder and harder to defend yourself against this crap. The backlash is fkng crazy.
The other day there was this 21 year old English soccer player. Some chick puts out this story how she got a bloody face and how the guy attempted rape, people go apeshit only for the chick to confess the very next day it was a fluke, a revenge type of post, no blood, no rape. She doesn't sue, the parents explain it was a mistake, but he guy still gets sued, is found innocent, but the backlash is so severe his contract is terminated. At 21! Oh and guess what, by the time his contract is terminated they are all lovey dovey, having a new born baby and expecting another, but dumb ass biatches don't care about that, they only go for the empowerment angel.

Steven Tyler Scores Partial Victory in Child Sex Assault LawsuitNancy Dillon Tue, March 12, 2024 A California lawsuit alleging Steven Tyler sexually abused a 16-year-old girl in the 1970s is moving ahead in a slightly reduced form after a successful challenge from the Aerosmith singer. Los Angeles County Superior Court Judge Ronald F. Frank ruled Tuesday that accuser Julia Misley (formerly Julia Holcomb) was beyond the two-year statute of limitations when she included in her lawsuit a pair of emotional distress claims linked to the 1997 Aerosmith book Walk This Way: The Autobiography of Aerosmith and Tyler’s 2011 book Does the Noise in My Head Bother You?: A Rock ‘N’ Roll Memoir. The judge struck the book-related claims from Misley’s underlying lawsuit but said the 66-year-old plaintiff could still pursue distress damages stemming from her remaining causes of action for child sexual assault and child sexual battery. Those causes of action form the core of Misley’s complaint filed in December 2022 under state legislation that temporarily waived filing deadlines for decades-old claims of childhood molestation. In her lawsuit first reported by Rolling Stone, Misley alleges Tyler sexually assaulted her shortly after her sixteenth birthday and groomed her to engage in a three-year relationship in which he became her legal guardian and allegedly “coerced” her to have an abortion. Tyler has denied any wrongdoing, claiming he loved Misley and nearly married her. During the Tuesday hearing, Misley’s lawyer, Michael Reck, argued that the lawsuit’s book-related claims were “inextricably” linked to the alleged sexual abuse and should be covered by the revival window of the California Child Victims Act. He argued that Tyler’s “prurient” descriptions of sex with Misley included in his memoirs bordered on “child pornography” and were not protected by the First Amendment. “It’s simply a perpetrator bragging about his crime and making money off of it,” Reck told the court. He said Tyler’s accounts of the alleged abuse caused his client great distress. “Writing the book without her consent, outing her to her family and friends, is a continuation of the pattern of conduct that is uninterrupted for decades. It absolutely relates to the sexual assault, which is what the statute revives,” Reck said. “The tort never ended. The tort started when it started and continued through the time the books were published.” Tyler’s lawyer, David Long-Daniels, argued that his client was “talking about a woman he thought was the love of his life.” He said Tyler “is not a criminal and has never been convicted of anything.” Though the written motion that was the subject of Tuesday’s hearing focused on Tyler’s books, Long-Daniels argued that Misley’s entire claim for Intentional Infliction of Emotional Distress (IIED) should be stricken as being too old to pursue, even as it relates to her claims of abuse dating back to when she was a minor. The judge disagreed. He struck only the claims related to the books published after Misley turned 18. “Although the court is understanding of the fact that the memoirs may have triggered the memory of alleged childhood sexual abuse, the revival statute revives actions that were allegedly endured by plaintiffs when the plaintiff was a minor,” Judge Frank said in his ruling. He said the deadline for Misley to sue over the books would have been “2013 at the latest.” “We agree with the judge’s reasoning. He followed the law. It’s a good day for us,” Long-Daniels told Rolling Stone after the hearing. No trial date has been set in the case, but a follow-up hearing is scheduled for late April. Last month, a separate lawsuit accusing Tyler of sexual assault was dismissed by a New York judge because the plaintiff, former child model Jeanne Bellino, didn’t allege that Tyler’s actions posed “a serious risk of physical injury.” The judge said that with that omission, her complaint failed to meet the criteria for New York’s Victims of Gender-Motivated Violence Protection Act, the law she used to file. Bellino’s lawyer, Jeff Anderson, responded that Tyler’s lawyers failed to serve their motion to dismiss on Bellino, so she wasn’t given the appropriate time to reply. In a March 7 order, the court said Bellino could pursue a motion to amend her complaint.

I will never understand why some guys (or gals) have any desire to date anyone who is underage. Aside from it being morally, ethically and legally wrong, there are also plenty of fish in the sea, aged 18+. Steven was over 9 years older than her, she was still a child, and at that point he could have had his pick of women of an appropriate age - even with Aerosmith just starting out.
There has to be some kind of sick power dynamic in it, because I can’t fathom being 25 and dating a girl who is likely still a sophomore in high school, just getting her driver’s license, not able to go to bars/drink alcohol, and just being immature, as most 16-year-olds are.
I will never get into the whole victim-shaming thing, but I’d think she would also hold her parents accountable - what parent in their right mind would allow such a thing?! (I realize her parents have likely passed away by now).
